1. Qué es Kinover (y qué no es)1. What Kinover is (and is not)

Kinover es una herramienta para que un kinesiólogo arme una pauta de recuperación por semanas y su paciente la siga desde el teléfono, la tablet o el navegador, con check-ins que el profesional revisa. Lo ofrece [RAZÓN SOCIAL] (“Kinover”, “nosotros”).Kinover is a tool for a physiotherapist to build a week-by-week recovery plan that their patient follows from their phone, tablet or browser, with check-ins the professional reviews. It is provided by [RAZÓN SOCIAL] (“Kinover”, “we”).

Kinover no presta atención sanitaria ni da consejo médico. No es un dispositivo médico, no es una ficha clínica certificada y no sustituye la evaluación de un profesional. El kinesiólogo que crea la pauta es el único responsable del contenido clínico, de su adecuación al paciente y de cómo reacciona a los check-ins y a las alertas. Un aviso de Kinover (por ejemplo, la alerta cuando un paciente marca un síntoma de alarma) es una notificación, no un diagnóstico ni una urgencia gestionada por nosotros: ante un síntoma grave, el paciente debe contactar a su profesional o a los servicios de urgencia.Kinover provides no healthcare and no medical advice. It is not a medical device, not a certified clinical record, and does not replace professional assessment. The physiotherapist who creates the plan is solely responsible for its clinical content, its suitability for the patient, and how they respond to check-ins and alerts. A Kinover notice (for example the alert when a patient ticks a warning symptom) is a notification, not a diagnosis nor an emergency handled by us: with a serious symptom, the patient must contact their professional or emergency services.

2. Cuentas2. Accounts

• Los kinesiólogos crean su cuenta directamente y declaran ser profesionales habilitados para ejercer donde atienden.Physiotherapists create their own account and declare they are professionals licensed to practise where they work.
• Los pacientes entran solo por invitación de su kinesiólogo, activan la cuenta con un enlace de un solo uso y eligen su propia contraseña. El paciente nunca paga.Patients join only through their physiotherapist's invite, activate the account with a one-time link and choose their own password. Patients never pay.
• Cada persona es responsable de mantener su contraseña en secreto y de lo que se haga con su cuenta.Everyone is responsible for keeping their password private and for what is done with their account.
• Un paciente menor de edad solo puede ser invitado con el consentimiento de su madre, padre o tutor.A minor may only be invited with a parent's or guardian's consent.

3. Uso aceptable3. Acceptable use

No uses Kinover para acceder a datos de pacientes que no son tuyos, para introducir contenido ilegal, ofensivo o que infrinja derechos de terceros (incluidos vídeos que no tengas derecho a enlazar), para interferir con el servicio o para fines distintos de la atención kinesiológica. Podemos suspender una cuenta que incumpla esto.Do not use Kinover to access patient data that is not yours, to enter content that is illegal, offensive or infringes third-party rights (including videos you have no right to link), to interfere with the service, or for purposes other than physiotherapy care. We may suspend an account that breaches this.

4. Planes, pagos y cancelación4. Plans, payments and cancellation

La suscripción es del kinesiólogo. Los planes vigentes son:The subscription belongs to the physiotherapist. Current plans are:

• Los pagos se procesan a través de Flow; Kinover no ve ni guarda los datos de tu tarjeta. El cobro se repite al final de cada periodo (mes o año) hasta que canceles.Payments are processed through Flow; Kinover never sees or stores your card details. The charge repeats at the end of each period (month or year) until you cancel.
• Puedes cancelar cuando quieras desde la pantalla de suscripción. La cancelación aplica al final del periodo ya pagado; no hay reembolso proporcional salvo que la ley lo exija.You can cancel at any time from the subscription screen. Cancellation takes effect at the end of the paid period; there is no pro-rata refund unless required by law.
• Si bajas de plan y tienes más pacientes activos de los que permite el nuevo, no perderás datos: no podrás añadir pacientes hasta estar dentro del límite.If you downgrade with more active patients than the new plan allows, you lose no data: you cannot add patients until you are within the limit.
• Los precios pueden cambiar; te avisaremos con al menos 30 días para las renovaciones siguientes.Prices may change; we will give at least 30 days' notice before it applies to following renewals.

5. Tus datos y tu contenido5. Your data and your content

La pauta que crea un kinesiólogo y los check-ins de un paciente son de ellos; Kinover solo los trata para prestar el servicio, como describe la política de privacidad. Nos das el permiso mínimo necesario para guardar, mostrar y sincronizar ese contenido entre tus dispositivos y con tu kinesiólogo o tu paciente.The plan a physiotherapist creates and a patient's check-ins belong to them; Kinover only processes them to provide the service, as described in the privacy policy. You grant us the minimum permission needed to store, display and sync that content across your devices and with your physiotherapist or patient.

6. Eliminación y cierre de cuentas6. Deleting and closing accounts

Puedes eliminar tu cuenta desde la app web o la app móvil (Perfil → Eliminar mi cuenta). Un kinesiólogo debe antes finalizar o borrar los programas activos de sus pacientes. Podemos cerrar cuentas que incumplan estos términos o que lleven mucho tiempo inactivas, avisando por email cuando sea razonable. Si Kinover dejara de operar, avisaremos con antelación para que puedas exportar o descargar tu información.You can delete your account from the web app or the mobile app (Profile → Delete my account). A physiotherapist must first finish or delete their patients' active programs. We may close accounts that breach these terms or have been inactive for a long time, notifying by email where reasonable. If Kinover were to shut down, we would give advance notice so you can export or download your information.

7. Disponibilidad y cambios en el servicio7. Availability and changes to the service

Kinover está en fase temprana. Intentamos que esté siempre disponible, pero puede haber interrupciones por mantenimiento o fallos; la app móvil guarda la pauta en el teléfono para que una caída no te deje sin sesión. Podemos cambiar o retirar funciones; si un cambio afecta de forma sustancial a lo que pagas, te avisaremos antes.Kinover is at an early stage. We try to keep it always available, but there may be interruptions for maintenance or failures; the mobile app keeps the plan on the phone so an outage does not leave you without a session. We may change or withdraw features; if a change substantially affects what you pay for, we will tell you beforehand.

8. Responsabilidad8. Liability

En la medida que la ley lo permita, Kinover no responde por daños derivados del uso clínico de la herramienta, de decisiones tomadas a partir de la información que muestra, de contenido introducido por usuarios, ni de interrupciones del servicio. Nuestra responsabilidad total frente a un kinesiólogo se limita a lo pagado por la suscripción en los doce meses anteriores. Nada de esto limita derechos que la ley chilena de protección al consumidor te reconozca como irrenunciables.To the extent the law allows, Kinover is not liable for damages arising from clinical use of the tool, from decisions made on the basis of the information it shows, from user-entered content, or from service interruptions. Our total liability towards a physiotherapist is limited to what was paid for the subscription in the previous twelve months. Nothing here limits rights that Chilean consumer law grants you as non-waivable.

9. Ley aplicable9. Governing law

Estos términos se rigen por las leyes de la República de Chile. Cualquier disputa se someterá a los tribunales de [CIUDAD], Chile, sin perjuicio de los derechos que te asistan como consumidor.These terms are governed by the laws of the Republic of Chile. Any dispute is submitted to the courts of [CIUDAD], Chile, without prejudice to your rights as a consumer.
